Terms & Conditions of Sale and Use

1. Who we are

Picturing Places is operated by Picturing Bits SASU, a French simplified joint-stock company (société par actions simplifiée unipersonnelle), registered with the Paris Trade and Companies Register under SIREN 940 613 375.

In these Terms, “Picturing Places”, “Picturing Bits”, “we”, “us” and “our” refer to Picturing Bits SASU.

2. About Picturing Places

Picturing Places lets you create personalised map artwork by selecting a place and customising the map style, colours, text, layout and other available options.

You may order personalised physical products or download free digital artwork where those options are available. We do not currently sell digital files. Current products, specifications and prices are shown on the website.

3. Creating and checking your design

You are responsible for reviewing your personalised design before ordering. Please check the location, map position, text, spelling, dates, colours, layout, product, size, frame or hanger and every other option you select. We do not normally correct personalisation choices.

The preview is a reasonable representation. Screens, printing processes, paper, materials, framing, cropping and manufacturing tolerances may cause minor differences. Normal variations do not affect your statutory rights where a product is defective or non-conforming.

Placing an order

Before ordering, you can review the product’s principal characteristics, personalisation, total price and delivery charges. By ordering, you confirm that your information and delivery address are accurate, that you approve the design and options, and that you accept these Terms.

Submitting an order does not itself mean we have accepted it. Before production, we may refuse or cancel an order if payment is not authorised, a product is unavailable, there is an obvious pricing or technical error, we cannot fulfil the destination, or we reasonably suspect fraud, unlawful activity or misuse. If we cancel after payment and before fulfilment, we will refund the cancelled order.

Prices, VAT and payment

Consumer prices include applicable VAT where required unless clearly stated otherwise. Delivery and other mandatory charges payable to us are shown before purchase. Stripe securely processes physical-product payments. We receive transaction details needed to administer the order, but not complete payment-card details.

For destinations where taxes or duties are not collected at checkout, the recipient may be responsible for import duties, taxes or customs charges. Where required, we will provide relevant pre-purchase information.

4. Physical products, production and delivery

Physical products are made to order from your design and selected options. Product pages describe their principal characteristics. We may use specialist production and fulfilment partners, but your contract remains with Picturing Bits and you should contact us about an order problem. We may change partners without changing the agreed characteristics of an accepted order.

Production may begin shortly after acceptance. Unless expressly guaranteed, production and delivery dates are estimates. We deliver to destinations available at checkout. You must provide a complete, accurate address and contact us immediately about an error. We will try to correct it, but cannot guarantee changes after production or dispatch. Additional costs may apply to resend an order that could not be delivered because the supplied address was incorrect or incomplete. Mandatory delivery rights remain unaffected.

Damaged, incorrect or non-conforming products

Contact [email protected] if an order is damaged, incorrect, defective or otherwise non-conforming. We may request photographs of the product, packaging and shipping label and a description. Depending on your rights and the circumstances, the remedy may include replacement, repair where appropriate, price reduction or refund. Our reporting procedure does not reduce mandatory rights.

5. Personalised products and consumer rights

Our physical products are manufactured to your individual choices and are clearly personalised. Where the legal exception for goods made to a consumer’s specifications or clearly personalised applies, the statutory 14-day right of withdrawal does not apply.

We voluntarily allow cancellation before production where possible. Contact us as soon as possible; if production has not begun and we can stop the order, we will cancel it and refund it in full. Once production begins, an order cannot be cancelled or changed merely because you changed your mind. This does not limit rights concerning damaged, defective, incorrect or non-conforming products.

Legal guarantees

Consumers benefit from mandatory legal guarantees. For consumers protected by French law, these include the legal guarantee of conformity (garantie légale de conformité) and the guarantee against hidden defects (garantie des vices cachés). Picturing Bits remains responsible as seller even when a partner manufactures or ships the product.

The mandatory French-language information concerning these guarantees will be included in the French version of these Terms in accordance with the French Consumer Code.

6. Free digital artwork

Unless expressly stated otherwise, free wallpapers and other free digital artwork are licensed for personal, non-commercial use only. You may use them on your own devices and keep reasonable backups. You may not sell, sublicense, redistribute or commercially exploit them, offer them through a marketplace or print-on-demand service, or present them as your own work.

A physical-product purchase does not include a digital file unless this is expressly stated when you order.

7. Intellectual property and map data

Picturing Bits and its licensors retain all rights in the service and its original software, artwork, map styling, layouts, visual designs, branding and design system. Personalisation does not transfer ownership of those materials. We do not claim ownership of third-party geographic data.

The creator uses data derived from OpenStreetMap contributors, may use Natural Earth, and uses Geoapify for place search. OpenStreetMap data is available under the Open Data Commons Open Database Licence. Additional attribution or licensing information may accompany artwork. Your artwork licence grants no rights in third-party data beyond the applicable licences.

8. Acceptable use, availability and liability

You must not use Picturing Places unlawfully, infringe another person’s rights, interfere with service operation or security, seek unauthorised access, or systematically extract or reproduce the service beyond what law permits. You are responsible for text and content you add. We may refuse an order or restrict access where reasonably necessary to protect the service, users or third parties.

We aim to keep the service available and working correctly but do not guarantee uninterrupted or error-free operation. Subject to applicable law, we are not responsible for loss caused solely by circumstances outside our reasonable control. Nothing excludes liability that cannot legally be excluded or limits mandatory consumer rights.

Privacy and changes

Our Privacy Policy explains how we process personal information. We may update these Terms for service, product, provider or legal changes. Changes do not retrospectively alter accepted orders; the version in force at acceptance applies.

Governing law

These Terms are governed by French law. If you reside elsewhere, this choice does not remove mandatory consumer protections that apply to you. Nothing prevents either party from exercising rights before a competent court.
